1. Definitions

In these Terms and Conditions:

  • "We," "Us," "Our," or "Fablecraft" refers to Fablecraft, a watch repair and maintenance service provider operating from 56 Jalan Raja Chulan, 50200 Kuala Lumpur, Malaysia.
  • "You" or "Client" refers to the individual or entity using our services or accessing our website.
  • "Services" refers to watch repair, restoration, assessment, and related horological services provided by Fablecraft.
  • "Timepiece" or "Watch" refers to any mechanical or quartz timepiece submitted to us for service.
  • "Agreement" refers to the acceptance of these Terms and Conditions when you engage our services.

2. Acceptance of Terms

By using our services, submitting a watch for repair or assessment, or accessing our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

You must be at least 18 years of age to enter into this Agreement. By using our services, you represent that you are of legal age and have the capacity to enter into binding contracts.

3. Services Provided

Fablecraft provides the following services:

  • Dial Repainting: Complete refinishing of deteriorated watch dials using period-appropriate techniques
  • Master Watchmaker Assessment: Comprehensive evaluation and documentation of timepiece condition
  • Mineral Crystal Polishing: Restoration of scratched mineral-glass crystals
  • Consultation Services: Professional advice regarding watch care and service needs

Services are subject to availability and our assessment of feasibility. We reserve the right to decline service requests that fall outside our expertise or capacity.

4. Service Process

4.1 Initial Assessment

Before commencing any work, we conduct an initial assessment of your timepiece to determine the appropriate service approach and provide an estimate. This assessment may reveal additional issues not initially apparent, which will be discussed with you before proceeding.

4.2 Service Authorization

Work begins only after you have reviewed and approved our service estimate. Any additional work discovered during the service process requires your explicit authorization before we proceed.

4.3 Timelines

We provide estimated turnaround times for each service. While we strive to meet these timelines, they are estimates and may be affected by unforeseen complications, parts availability, or other factors beyond our control. We will communicate any delays promptly.

4.4 Communication

We maintain regular communication throughout the service process. You are responsible for providing accurate contact information and responding to our communications in a timely manner.

5. Payment Terms

5.1 Pricing

Service rates are provided in Malaysian Ringgit (MYR) and are subject to change. Quoted prices are valid for 30 days from the date of estimate. Prices include labour and standard materials; any specialized parts or materials will be quoted separately.

5.2 Payment Methods

We accept payment via bank transfer, cash, or other methods as agreed upon. Payment is due upon completion of service and before the timepiece is released back to you.

5.3 Assessment Fees

Master Watchmaker Assessment fees are payable regardless of whether you choose to proceed with recommended repairs or services.

5.4 Cancellation

If you cancel a service after work has commenced, you will be charged for work completed up to the point of cancellation, including any assessment or diagnostic work performed.

6. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information about your timepiece, including any previous repairs or modifications
  • Disclose any known issues, damage, or special considerations regarding the watch
  • Maintain appropriate insurance coverage for valuable timepieces while in our care
  • Collect your timepiece promptly after notification of service completion
  • Review completed work and raise any concerns within 14 days of collection
  • Follow care and maintenance recommendations provided

7. Warranties and Disclaimers

7.1 Service Warranty

We warrant that services performed will be executed with appropriate skill and care. If defects in our workmanship become apparent within 90 days of service completion, we will remedy the issue at no additional charge, provided the watch has not been subjected to misuse, unauthorized repair, or other damage.

7.2 Parts and Materials

Parts and materials supplied carry manufacturer warranties where applicable. We do not warrant third-party components beyond these manufacturer warranties.

7.3 Vintage and Aged Timepieces

For vintage watches or timepieces with aged components, we provide services on an "as-is" basis with an understanding that older materials may have inherent vulnerabilities. We will discuss these considerations during the assessment phase.

7.4 Disclaimer of Guarantees

While we strive for excellence in all services, we cannot guarantee specific outcomes such as exact colour matching in dial repainting or complete removal of all scratches in crystal polishing. We discuss realistic expectations before commencing work.

7.5 Service "As Is"

Our services are provided "as is" without implied warranties of merchantability or fitness for a particular purpose, except as expressly stated in these terms or required by applicable law.

8. Limitation of Liability

8.1 Extent of Liability

Our liability for any claim arising from services provided is limited to the amount paid for the specific service in question. We are not liable for any indirect, consequential, or incidental damages.

8.2 Care and Custody

While timepieces are in our care, we take appropriate security measures to prevent loss or damage. However, we recommend clients maintain their own insurance coverage for valuable items. Our liability for loss or damage while in our custody is limited to MYR 5,000 per timepiece unless higher coverage is specifically arranged and paid for in advance.

8.3 Force Majeure

We are not liable for delays or failure to perform services due to circumstances beyond our reasonable control, including natural disasters, power failures, equipment malfunction, or other force majeure events.

9. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Fablecraft or our content providers and is protected by Malaysian and international copyright laws. You may not reproduce, distribute, or create derivative works from our website content without written permission.

Service reports, photographs, and documentation we provide remain our intellectual property but may be used by you for purposes related to your timepiece ownership, insurance, or resale.

10. Uncollected Timepieces

If a timepiece remains uncollected for 90 days after notification of service completion, we reserve the right to charge storage fees of MYR 50 per month. After 180 days, we may dispose of uncollected items in accordance with Malaysian law, with proceeds applied to outstanding fees and storage charges.

We will make reasonable efforts to contact you before taking such action, but you are responsible for maintaining current contact information with us.

11. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and the Personal Data Protection Act 2010 (Malaysia). By using our services, you consent to such processing as described in our Privacy Policy.

12. Dispute Resolution

12.1 Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the Malaysian courts.

12.2 Informal Resolution

In the event of any disagreement or dispute, we encourage you to contact us first to attempt an informal resolution. Many concerns can be addressed through direct communication.

12.3 Mediation

If informal resolution is unsuccessful, both parties agree to attempt mediation before pursuing formal legal action. Mediation costs will be shared equally unless otherwise agreed.

13. Indemnification

You agree to indemnify and hold harmless Fablecraft, its employees, and agents from any claims, damages, or expenses arising from your misuse of our services, violation of these terms, or provision of inaccurate information about your timepiece.

14. Termination

We reserve the right to refuse service or terminate our relationship with any client for reasonable cause, including non-payment, abusive behavior toward staff, or provision of false information. In such cases, you will be charged for work completed up to the point of termination.

15. General Provisions

15.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Fablecraft regarding the use of our services.

15.2 Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations to a successor business entity.

15.5 Notice

16. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective when posted on our website with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

For ongoing service relationships, we will notify you of material changes that affect your current service agreement.
